Debt Settlement

An Alternative to Bankruptcy

Share

Although it is sometimes necessary to file bankruptcy, it is quite possible that Bankruptcy is not the right solution for you. Perhaps you do not qualify for Chapter 7, or you do not want to make structured payments through a Chapter 13 for 3 to 5 years. We strongly advocate debt negotiation as an alternative to Bankruptcy when possible and when needed. At the McCormick Firm, we are qualified and experienced in resolving debt without resorting to Bankruptcy. Our experienced attorneys can help you negotiate debt settlements with your creditors for all your debts including credit cards, personal loans, and medical bills.

How to Negotiate Your Debt Settlement

You start with a free consultation. We review your finances to determine what is the best process for you. If you qualify for debt negotiation, your debts may be settled for less than what you currently owe. We work relentlessly to settle your debts to prevent garnishments, liens, and foreclosures.

Beware of Consumer Credit Counseling

Consumer Credit Counseling (CCC) are representatives who essentially create a budget for you to create a pay off on your debt through a payment plan. However, such payments are often higher than your current minimum payments and it takes only one creditor to reject the payment plan to sue you.

Beware of Debt Consolidation

Consolidation of your debts are similar to Consumer Credit Counseling, and often requires you paying a premium to the consolidation provider for their attempts to consolidate your debts. They can make no guarantees that all of your creditors will accept the offered payment and again, it takes only one creditor to reject the payment plan to sue you. Also, such programs often require the use of collateral, placing a lien on your property, and the use of a home equity loan. Such risks are not necessary. In fact, many such companies do not employ a single attorney and simply send letters to your creditors on your behalf which you could simply do yourself.

Restore your credit by eliminating your debt

By negotiating your debt, you are able to begin to restore your credit score. We have the experience to sue creditors to force the removal of such effects and inaccuracies. By freeing yourself from debt and correcting the inaccuracies on your credit report, we can help you increase your credit score. We understand and know how to use the Fair Credit Reporting Act, Fair Debt Collection Practices Act, Fair Credit Billing Act, and Fair and Accurate Credit Transactions Act to your benefit.
